The intellectual property system is the sum of what is established in the minds of consumers about a product or service provided by a specific company, and the customer is thus able to distinguish and recognize this brand. Therefore, a trademark has a power that cannot be underestimated, and a trademark may be exposed to threats such as theft or imitation in a similar commercial activity, which will negatively affect its durability and success. So, how do we protect the trademark from these risks?

Tip: The trademark is a means of guarantee for how to price the product and the consumer at the same time, as it prevents products bearing a specific brand from being mixed up with similar products bearing another brand.

What do we mean by trademark protection?

In the Kingdom of Saudi Arabia, intellectual property rights are protected under the applicable laws and regulations. One of the most prominent forms of intellectual property that is protected is trademarks. A trademark is a valuable property for any company or organization, and provides it with a strong distinctive identity in the competitive market, therefore, trademark protection is essential to ensure business sustainability and maintain the company's reputation and competitive edge.

The Saudi intellectual property system protects trademarks through the Saudi Authority for Intellectual Property (SAIP). The Authority is considered the main reference in the Kingdom for everything related to intellectual property and providing services related to it, and the Authority works to regulate and implement laws and regulations that protect intellectual property rights, including trademark rights.

How does the intellectual property system protect the trademark?

To protect your trademark in the Kingdom of Saudi Arabia, you are required to submit a trademark registration application to the Saudi Authority for Intellectual Property, and the requested trademarks must meet a set of standards and conditions to be eligible for registration. Upon registering the trademark, you will obtain an exclusive right to use it in the market, and you can take legal action against anyone who infringes your trademark rights.

The Saudi intellectual property system also includes procedures for resolving disputes related to trademarks through litigation, mediation, or negotiation. The system works to provide a fair and reliable environment to protect intellectual property rights and encourage innovation and creativity in the Kingdom of Saudi Arabia.

In short, the Saudi intellectual property system is an important tool for protecting trademarks and ensuring intellectual property rights in the Kingdom of Saudi Arabia by providing the legal and regulatory environment that enables companies and institutions to register and protect their trademarks, thereby protecting their identity and reputation in the local and global markets.

Steps to Register a Trademark in the Saudi Intellectual Property System

To register a trademark with the Saudi Authority for Intellectual Property in the Kingdom of Saudi Arabia, the following marketing plan must be followed:

1- Verify trademark availability: Before submitting the registration application, it must be ensured that the trademark to be registered has not been previously registered with the Authority.

2- Prepare the required documents: The following documents and information must be prepared to be submitted with the registration application:

  • Detailed copy of the trademark, including the logo and colors used (if applicable).

  • Classification and description of the goods or services for which you wish to register the mark.

  • Trademark owner information, including full name, address, and nationality.

  • Details of the authorized agent if an agent has been appointed to handle the registration process on behalf of the merchant.

3- Submit the registration application: After preparing the required documents, the registration application must be submitted to the Saudi Authority for Intellectual Property. The application can be submitted in person, by mail, or online through the Authority's website.

4- Application auditing: After submitting the application, the Authority will audit and examine it to ensure that all legal requirements and specified conditions are met. If there is any deficiency or problem with the application, you may be asked to provide more information or modifications.

5- Announcement and publication: After auditing the application and ensuring that all conditions are met, the submitted trademark is announced and published, where the mark's information is published in the public trademark register for a period of 60 days, and any third party can file an objection if they have any claims or justifications against the registration of the mark.

6- Registration decision: In the absence of any valid objections or claims within the specified period, and if all conditions in the system and required terms are met, the Authority will issue a decision to register the trademark, then the merchant obtains a registration certificate proving their rights in the trademark for a period of ten years, renewable.

Finally..

The Saudi intellectual property system is considered an effective system to protect trademarks and encourage innovation and investment in the Kingdom of Saudi Arabia. The role of the system is to provide the legal protection, laws, and necessary procedures to ensure that companies and institutions can benefit from the economic value of their trademarks and maintain their distinction in the market. How do you measure improvement?

How do you measure improvement?

Monitor the weekly order completion rate on the Salla dashboard, and compare it before and after every change. Focus specifically on mobile devices, as they account for the majority of visits in the Saudi and Gulf markets. Small, continuous improvement is better than major changes whose impact is difficult to attribute.
